Azerbaijan Entrepreneurs Confederation And Bar Association Established Mediation Council

In accordance with the Decree of the President Ilham Aliyev “On deepening of the reforms in the judicial-legal system” on April 3, 2019  and the “Law on Mediation” on December 2, last year, with the support of the EU Delegation to Azerbaijan group created.

The working group includes the Presidential Administration of the Republic of Azerbaijan, the Ministry of Justice, the National Confederation of Entrepreneurs (Employers) of the Republic of Azerbaijan, the Small and Medium Business Development Agency, the Supreme Court, the State Agency for Public Service and Social Innovations under the President of the Republic of Azerbaijan, the Bar Association and the EU Delegation to Azerbaijan were represented through authorized representatives.

As a result of the activity of the Working Group, the Charter of the Mediation Council was addressed by the National Confederation of Entrepreneurs (Employers) Organizations of the Republic of Azerbaijan and the Bar Association of the Republic of Azerbaijan. On February 12 this year, the “Mediation Council ” non-commercial legal entity was established, on February 16 it was registered by the Ministry of Justice.

In this regard, on March 3, by the decision of the Mediation Council, the Academy of Justice of the Ministry of Justice was accepted as a member of the Mediation Council as a mediation training institution. The Mediation Council, guided by Article 20.1.6 of the Law on Mediation, on April 8, approved “Proposal on application of mediation process”, “Application for mediation”, “Letter of invitation to mediation”, “Agreement on application of mediation process”, “Reconciliation agreement”, “Certificate of non-participation in the initial mediation session”, “Certificate of non-participation in the initial mediation session if there is a provision on mediation in the contract”, “ Certificate on inability to continue the process after the initial mediation session ”,“Protocol on termination of the mediation process”.

In addition, the Mediation Council approved the “Instructions for the collection of statistical data”, which includes the procedure for collecting statistical data and the evaluation request, and the “Procedure for admission to the Mediation Council”, which reflects the admission process.

Trainings scheduled for March and April have been postponed as a part of measures to prevent the coronavirus (COVID-19) pandemic. However, taking into account the above-mentioned measures, it is planned to hold trainings on the initial training of mediators at the Academy of Justice of the Ministry of Justice and work in relevant areas.
