According to Public Procurement Law of the Republic of Azerbaijan the procurement contract comes into force from the moment of signing by the consignor (contractor) and the procuring entity.

Obligations under the procurement contract can not be increased on terms and conditions not specified in the bidding protocol.

When signing a procurement contract, the procuring entity may increase the volume of goods (works and services) by 15 percent – with the consent of the relevant executive authority without changing the prices and criteria of each unit of goods (works and services).

Contractors who have won a tender can sign contracts with subcontractors to perform work, if they are agreed by the procuring entity and in the bidding. In all other cases, the performance of the contract can not be transferred to subcontractors without the written permission of the procuring entity.

If the procurement contract is to be approved by the highest governing body, the contract does not enter into force until the approval of the respective body. After the notice of acceptance of the tender proposal has been sent, the approximate period required for such approval is indicated in the bidding package.

Upon the entry into force of the procurement contract and, if necessary, the consignor (the contractor) notifies other shippers (contractors) of the contract while ensuring the enforcement of the contract. The notification shall indicate the name, address and price of the contract of the sender (contractor) that signed the contract.

The procurement contract specifies the circumstances and conditions for failure to fulfill or improper fulfillment by the parties of the obligations, terms of the

penalty, orders, resolution of disputes (stipulated in the main conditions of the tender and normative legal acts), extension of the beginning and termination of the case.
